Terms of Use

These Terms govern use of LumaNest services operated by Eric Yealdhall, a sole proprietor operating as LumaNest. By using the service, you agree to these Terms.

Support tool only

LumaNest is not a medical device, emergency-response service, or substitute for supervision or professional care. Sensor readings, notifications, and delivery confirmations can be delayed, unavailable, incomplete, or incorrect. Absence of an alert does not establish that a person is safe. Call 911 or the applicable emergency service in an emergency.

Accounts and authorized use

You must provide accurate information, protect account credentials, and use LumaNest only for lawful caregiving purposes. You must have appropriate permission to submit information about another person, including photographs, recordings, routines, and contact information.

SMS program

SMS participation is optional and subject to the LumaNest SMS Program Terms. Consent to SMS is not a condition of purchase. Message frequency varies. Message and data rates may apply. Reply STOP to opt out or HELP for help.

Acceptable use

You may not interfere with the service, attempt unauthorized access, misuse another person’s information, use the service for unlawful surveillance, or use LumaNest to send unsolicited messages.

Availability and changes

The service may change, be suspended, or become unavailable. Pilot and pre-release features may be incomplete and may change without notice.

Disclaimer

To the extent permitted by law, LumaNest is provided “as is” and “as available,” without warranties of uninterrupted operation, fitness for a particular purpose, or error-free alerts.

Limitation

To the extent permitted by applicable law, LumaNest and its operator will not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of or inability to use the service. Rights that cannot legally be excluded remain unaffected.
